- "Client", "you", "your" — refers to any individual who contacts us, uses our website, or engages our services.
- "Services" — refers to the pension protection legal services we offer, as described on our website and in any engagement letter.
- "Agreement" — refers to any formal engagement between Perisai Amanah and a client, confirmed in writing.
- "Content" — refers to all text, documents, and materials available on our website.
2. Acceptance of Terms
By using our website, submitting an enquiry, or engaging our services, you confirm that you have read and agree to these Terms and Conditions. If you do not agree, please do not use our website or services. You must be at least eighteen years of age to engage our services or enter into a legal agreement with us.
3. Description of Services
Perisai Amanah provides legal support services in connection with pension matters in Malaysia. Our services include document review and explanation, correspondence support with pension funds and authorities, and formal assistance including representation at hearings. Services are provided within Malaysia and governed by Malaysian law.
We do not provide financial advice, investment advice, or any service regulated by the Securities Commission Malaysia or Bank Negara Malaysia. Nothing on our website constitutes legal advice. Formal legal advice is provided only through a written engagement agreement.
4. Client Responsibilities
You agree to provide accurate, complete, and timely information when requested. You agree not to use our services for any unlawful purpose or to make any fraudulent claim. You are responsible for the accuracy of documents and information you provide to us. Any deliberate misrepresentation may result in the immediate termination of our engagement.
5. Intellectual Property
All content on this website, including text, layout, and design, is owned by or licensed to Perisai Amanah. You may view and print content for personal, non-commercial reference. You may not reproduce, republish, or distribute any content without our written permission. Nothing in these Terms grants you any licence to use our name, logo, or branding.
6. Payment Terms
Our fees for each level of service are set out clearly on our website and confirmed in writing before any work begins. Payment is due as agreed in the engagement letter. We accept payment in Malaysian Ringgit (RM) via bank transfer or such other methods as we may notify. We do not charge for an initial conversation.
If you wish to cease engagement before a matter is concluded, we reserve the right to charge for work already completed at a fair and reasonable rate, not exceeding the stated fee for the relevant service tier.
7. Service Delivery
We will carry out services with reasonable care and skill, in accordance with our professional obligations as members of the Malaysian Bar. Timelines stated during an engagement are estimates only and may be affected by the response times of third parties such as pension authorities or tribunals. We will keep you informed of any significant delays.
8. Disclaimers
Our services are provided in good faith on the basis of information available to us at the time. We make no representation that any particular outcome can be achieved, and nothing in our communications should be read as a prediction of success. Legal and regulatory positions may change, and our advice reflects the position at the time it is given.
Our website is provided "as is" without warranties of any kind. We do not accept liability for any loss arising from your reliance on website content alone, without formal engagement.
9. Limitation of Liability
To the extent permitted by law, our total liability to you in connection with any matter will not exceed the fee paid by you for the relevant service. We are not liable for indirect, consequential, or economic losses arising from our services or their interruption. Nothing in these Terms limits liability for fraud, death, or personal injury caused by our negligence.
10. Confidentiality
All communications between our practice and our clients are subject to legal professional privilege under Malaysian law. We will not disclose your information to third parties except as set out in our Privacy Policy or as required by law or court order. This obligation of confidentiality continues after the conclusion of any engagement.
11. Termination
Either party may terminate an engagement by giving written notice. Upon termination, we will return any documents provided to us and issue a final invoice for work completed. We may terminate without notice where we have reason to believe information provided to us has been materially misleading, or where continuing the engagement would place us in breach of our professional obligations.
12. Dispute Resolution
These Terms are governed by the laws of Malaysia. Any dispute arising from these Terms or our services shall first be referred to good-faith discussion between the parties. If unresolved within thirty days, either party may refer the matter to mediation under the auspices of the Malaysian Mediation Centre before pursuing court proceedings. The courts of Malaysia shall have jurisdiction.
13. General Provisions
These Terms, together with any engagement letter, constitute the entire agreement between us in relation to our services. If any provision is found to be unenforceable, the remaining provisions continue in full effect. Our failure to enforce any right under these Terms does not constitute a waiver of that right. These Terms may not be assigned by you without our prior written consent.
14. Changes to These Terms
We may update these Terms and Conditions from time to time. When we do, we will update the date shown above. Changes do not affect any engagement already in progress. Continued use of our website after a change constitutes acceptance of the updated Terms.
